ICC to Bring Case Against Darfuri Rebels?

Kevin Heller at Opinio Juris points to an announcement by the ICC's Chief Prosecutor that he will bring war crimes charges against Darfuri rebels.

As Heller ably lays out, it's not easy to decide what to think of the charges; the offense in question, an armed attack on African Union peacekeepers, seems appropriate for the exercise of ICC jurisdiction. Nonetheless, given Sudan's apparent ease in preventing any followup on indictments against three of its government officials, including its President, who are accused of leading a genocide that has cost a half million lives and displaced millions, the idea that the first Darfur prosecutions would be against rebel fighters accused of complicity in 12 deaths is difficult to comprehend.
